We increased our monthly maximum benefit amount from $9,000 to $12,000 for our Group Long-Term Disability Income Insurance, providing extra protection in case of a total disability. Remember, these are own-occupation benefits for up to five years, which will provide needed income if you are disabled and unable to continue working in your own profession, including specialty of law, not just any job. If you decide to change jobs or careers, you may lose your employer-provided insurance coverage, but you can “take” your ABE-sponsored coverage with you, as long as you remain an ABA member and otherwise meet eligibility requirements. This feature eliminates the hassle of securing new insurance coverage in the midst of an already stressful career move.

On October 15th the Wall Street Journal reported that for the first time since Cost-Of-Living-Adjustments were adopted in 1975, the Social Security Administration will not increase payments in 2010 for more than 50 million recipients. Read the entire article here. For Social Security Disability Recipients, that means that their monthly payments will not increase next year as they have for the last 35 years. As an ABA member, you have access to the ABE-sponsored Long-Term Disability Insurance plan, which has an optional Cost-of-Living-Adjustment which automatically adds 3% of your chosen monthly disability insurance benefit each year following your first year of total disability for up to five years. If you select this option when applying for insurance and are approved, this COLA benefit is guaranteed and can not be reversed. I was discussing our Disability plan with a member the other day and mentioned that a factor to consider regarding disability coverage is that if you pay the premiums yourself, versus having them paid by your law firm, your monthly benefits may be paid to you, tax free. (We do encourage you to confirm this with your tax adviser.) This means if you are currently paying the premium for a $10,000 monthly benefit amount and experience a qualifying disability you would receive that full monthly benefit payment. However, if you have the same benefit amount, but your law firm pays the premium, it is possible you may be taxed on the benefit received. Consult your tax adviser for more information.
